"Ain't That a Kick in the Head?" is a pop song written in 1960 with music by Jimmy Van Heusen and lyrics by Sammy Cahn. It was first recorded that year on May 10 by Dean Martin in a swinging big band jazz arrangement conducted by Nelson Riddle. Martin performed the song in the 1960 heist film Ocean's 11 in an alternate arrangement featuring vibraphonist Red Norvo and his quartet.
The song was covered in 2004 by Irish boy band Westlife on their sixth studio album, ...Allow Us to Be Frank. Despite not charting in Ireland and failing to appear on the UK Singles Chart, their cover of the song reached No. 4 on the UK Download Chart, peaked at No. 5 in Denmark, and charted within the top 50 in Flanders, the Netherlands, and Sweden.
Van Heusen and Cahn wrote the song specifically for the 1960 film Ocean's 11, though it was initially referred to press as "Ain't That a Kick in the Seat".[1] Dean Martin's single was released before the film, which premieredon August 10, 1960.
The actual song: Jawsh 685 is a 17-year-old producer from New Zealand with Samoan and Cook Island heritage who's still grappling with how ridiculously popular his track has become. It turns out Derulo used his sound without permission at first, but they've now worked it out.
The actual song: Doja Cat could honestly take up every spot on this list because everything she puts out tends to go viral on TikTok. Her song "Say So," for example, sparked a whole viral dance trend that then appeared in the official music video. "Boss Bitch" is less obviously a Doja Cat track, but also went super viral.
The actual song: BENEE is a New Zealand musician who's done well in her home country, but this song's TikTok success marks her first big international hit. It was initially released on a 2019 EP but went viral in March of this year.
The actual song: According to a Rolling Stone article about his viral fame, Curtis Waters is originally from Nepal but lives in North Carolina. When his track went big on TikTok, he chose to turn down big label record deals and stay independent.
There perhaps hasn't been a TikTok dance as viral or as controversial as the Renegade, set to this song. It was originally created by an Atlanta teen named Jalaiah Harmon and then re-enacted by seemingly everyone, often without credit. In her honor, below is the Instagram post that started it all.
This was another one of those only-on-TikTok viral songs. While it did have a dance trend associated this it, it blew up so big on the app that it was used as background music for pretty much anything and everything.
The actual song: This hit started as a viral TikTok from Curtis Roach (above) that was just him pounding on a table and rapping, but it was very catchy! Among the many people who lip-synched to the song was rapper Tyga, who loved it so much that he reached out to Roach to collab on a fresh version of the track.
The actual song: Cookiee Kawaii's track blew up on TikTok, then in turn blew up on Spotify. Cookiee is at home in the Jersey club scene and didn't even have a TikTok account when the song went viral.
The actual song: This whole thing stems back to 2016 and is sort of a UK legend. Millie B released this song about her grime music nemesis, Sophie Aspin, and the two traded diss tracks back and forth for a bit before eventually collaborating together.
The actual song: Avenue Beat is a trio of friends from Illinois who created the band when they were just 14. They told BuzzFeed News they put it on TikTok, thinking it could just live online, but it quickly went viral.

In short, no. Copyright law states that sampling any song without permission is breaking the law. If you've sampled sounds from copyrighted content, you need to get it cleared for a commercial release in order to keep it legal.
If you are after a popular commercial song this usually involves getting in touch with the publisher and working out a deal. As you can imagine, the licensing fees in this case may be quite substantial.
I really love editing so i decided to make channel in youtube by editing and combining pictures and videos with lyrics and using famous songs but i dont know what to do.. please help me. Thank you. Godbless.
Hi I am totally confused on this issue. I have recorded several songs (singing with artists and karaoke). I want to post these songs on you tube so my friends and family can hear them. Can I do this??
My daughter makes cute videos from Animal Jam and puts it to a,song she likes. Is this OK? I see TONS of lyric videos and stuff to all kinds of popular songs. I doubt everyone has gotten permission to use them.
Alternatively, license a song from an indie artist or a music library and use it in your videos. Having a valid license will help you defend against any possible copyright claims on your videos. Hope this helps!
Alternatively, you can get music from a music library. They make music specifically for videos and projects like yours. If you make lots of animations it will make sense to get a royalty free music subscription rather than licensing songs one by one.

It will tell you whether you can use a particular song and what will happen if you do. In many cases you can use it, as long as you agree to show ads in your videos (the ad revenue will go to the copyright owner).

Hi, can I monetize a video that is a music tutorial for a popular song? What if I taught the song on guitar by breaking it down into sections, without playing any of the original song? I could go bare bones to just chord progressions on most. Thanks!
